South LA mother sues LAUSD after 5-year-old son with autism was hit by a car outside his school

SOUTH LOS ANGELES (KABC) — A South Los Angeles mother is taking legal action against the Los Angeles Unified School District after her 5-year-old son with autism was hit by a car outside his school.

“They were supposed to keep my son safe, but they didn’t. They failed my child. They failed my child,” his mother, Catherine Garcia, said.

Flanked by her attorneys, Garcia is suing LAUSD over what happened to her son with special needs last month outside Parmelee Avenue Elementary School.

Her son suffered serious injuries when he somehow left his kindergarten class and went out into the street, where he was hit by a car.

“I was there supporting them. I was there every day. I was there available for them. And I want justice for my child,” Garcia said.

The boy’s family has filed a claim against the district, which is the first step before filing a lawsuit.

“They let him wander off campus, and boom! He was struck by a vehicle. A Camaro,” her attorney, Michael Carrillo, said.

The CHP has an ongoing investigation to determine exactly what happened.

In a written statement, the district said, “Los Angeles Unified does not comment on pending litigation. The district’s foremost priority is the safety and well-being of all students, and we extend our deepest concern and compassion to the student and family affected by this incident.”

The district has 45 days to respond to the claim; after that it becomes a lawsuit.
